Selling a Personalised Number Plate

The Seller of the registration number authorises MOTOR MARKS to advertise and sell the right to transfer the registration number to a Buyer that MOTOR MARKS shall find, at the price indicated and accepted in the written/emailed quotation provided. MOTOR MARKS will bear the cost of all advertising, administration and marketing of the number plate, subject to the Seller complying to the terms and conditions of their contracted agreement and thus at no cost to the Seller.

The Net payment made by MOTOR MARKS to the Seller of the registration number will be that already agreed in the quotation (unless the Seller makes a further reduction) or any lower offer agreed with the Seller prior to the sale by letter, email or telephone.

The Agency of MOTOR MARKS is valid indefinitely. It may only be cancelled upon written notice given by the Seller to MOTOR MARKS by recorded delivery prepaid post.

MOTOR MARKS will advertise the registration number on behalf of the Seller until a buyer is found, so it is the responsibility of the Seller to inform MOTOR MARKS immediately either by writing, email or telephone should they cease to be the owner of the vehicle that carries the registration number or if the vehicle is sold, stolen or destroyed or simply wishes the registration number to be removed from sale. The Seller must also notify MOTOR MARKS by writing, email or telephone if the vehicle which carries the registration number no longer has valid paperwork for a successful transfer.

The Seller must supply all relevant paperwork and documentation when requested by return post and must inform MOTOR MARKS immediately if there is any delay.

The Seller agrees to have his/her vehicle available for inspection by DVLA Swansea (or one of their officers) if required. (Please note the Chassis Number on the vehicle must tally up with the Chassis Number on the V5 Registration Document.)

MOTOR MARKS will not accept any liability for any losses incurred by the Seller through delay from the slow arrival of documents by the Buyer or if the Buyer fails to go ahead with the transaction.

A Buyer shall be deemed to be found once MOTOR MARKS have received a part payment. It should be noted that MOTOR MARKS are under no obligation to check availability prior to a sale being agreed as the written/emailed contract from the Seller is confirmation of availability.

If the Registration Number is held on a V778 Retention Certificate or a V750 Certificate of Entitlement the Seller is responsible in providing the original certificate to Motor Marks in order for us to arrange transfer of the registration and the document must be signed by the Grantee where indicated. The document must also be current, not expired.

If the Agency is not cancelled by the Seller and MOTOR MARKS finds a buyer the Seller shall be liable to pay MOTOR MARKS their commission, as it is not fair that MOTOR MARKS should incur expense in selling a Registration Number that is not after all available.

Upon completion of the Transfer the amount payable shall be made to the Seller by MOTOR MARKS. Where there is a donor vehicle involved in the transfer it is the responsibility of the Seller to purchase and fix new acrylic number plates bearing the replacement registration number to their vehicle after approval from DVLA Swansea and to notify their insurance company of the change of registration number.

The Secretary of State for Transport or their Agents, the DVLA (as keeper of the records), may at any time revoke the right to a registration number for whatever reason. In this event MOTOR MARKS cannot be held liable. MOTOR MARKS are also not liable for any changes in Government legislation. Current guidelines and legislation covering the transfer and sale of Vehicle Registration Numbers remain in force at all times.

Buying a Personalised Number Plate

MOTOR MARKS shall be responsible for handling the documentation required to transfer the registration number and will process all papers as quickly as possible; however MOTOR MARKS will not be liable for any losses caused due to delay other than on the part of MOTOR MARKS, nor if the DVLA revokes the right to a registration number. Nor will MOTOR MARKS be liable for any damages, interest or expense incurred.

The Buyer of any registration number shall be responsible for sending to MOTOR MARKS the payment for the assignment fee of £80.00 made payable to DVLA Swansea and for producing all the required documentation for the vehicle onto which the registration number will be transferred (if required).

After 9th March 2015 any applications made for a Retention Certificate the fee will be £80.00.

The Buyer must provide full payment before any transfer shall be completed with the online transfer facility or submitted to the DVLA Department of Transport Office at Swansea. This payment must be within 14 days of securing the registration by an initial part payment or the transaction will be deemed a failure and thus lose the Buyer their part payment, unless a longer period of time has been agreed with MOTOR MARKS. Vehicle documents must also be received within a maximum of 28 days from receipt of part payment, or as prescribed by Motor Marks if a longer period is granted.

If you have purchased a Prefix or Current Style number plate then payment is required immediately in order for us to secure the registration number for you.

If the Buyer wishes to have the registration mark purchased and supplied on a DVLA retention certificate it will be subject to the possibility of the mark being retained as confirmed by MOTOR MARKS. The Retention/Entitlement certificate will not be released up until available and receipt of the completed release/disclaimer form that MOTOR MARKS will provide to the buyer.

Please note: Once a purchase is placed for all registration numbers, the registration is deemed to be specifically to the requirements of the Buyer therefore it is considered a personalised item. This means under the Consumer Contracts Regulations 2013 if the Buyer does not proceed with the transfer of the registration number after paying a part payment/full payment to MOTOR MARKS or fails to supply the full documentation required by the DVLA to process the transfer, then no part of this payment is refundable whatsoever, as the service period commences immediately. Ordered numbers cannot be refunded or exchanged, nor will any cancellations be accepted as upon receipt of an order the Buyer is agreeing to give us consent to waive their 14 day cooling off period.

The acceptance of our terms on any internet order will also bind the person placing the order to commit to the purchase, and provide full payment as agreed when forming the contract. If this is not authorised by the internet order it will need to be provided by alternative methods, as the contract to purchase is formed by entering full purchase details.

If the transaction fails due to no fault on the part of the Buyer other than as above, they will be given a full refund of monies paid to MOTOR MARKS and all documentation shall be returned. The fee that was paid to DVLA Swansea of £80.00 will be refunded to the Buyer directly from DVLA Swansea at a later date.

The issue of a new Vehicle Registration Document V5/C (if a vehicle was involved) bearing the new registration number to the Buyer from the DVLA Swansea or a V778 Retention Document or V750 Certificate of Entitlement shall be conclusive proof that a successful transfer has taken place.

It is the responsibility of the Buyer to purchase and fit new car number plates to their vehicle and to notify their insurance company of the change of registration.

If you choose the option to purchase acrylic number plates from MOTOR MARKS: should there be any faults relating to the order this must be raised within 48 working hours of receipt of the plates and the product returned to our offices. Replacement plates will then be manufactured and despatched within 48 working hours of receipt of same.

It should be noted that the Secretary of State for Transport or their Agents the DVLA (as keeper of the records) may at any time revoke the right to a registration Mark for whatever reasons, and in this event MOTOR MARKS cannot be held liable in the unlikely event of this occurring.

MOTOR MARKS are also not liable for any changes in Government legislation. Current guidelines and legislation covering the transfer and sale of vehicle Registration Numbers remain in force at all times.
